
GoMundo has once again been vindicated by the judge in its case with Ryanair. The dispute revolved around the reimbursement of the flights booked by GoMundo and cancelled by Ryanair in connection with corona. During the summary proceedings at the North Holland District Court (Haarlem, ed.) that took place at the end of last May, the interim relief judge already ruled that Ryanair had to pay GoMundo a sum of over two tons upon GoMundo’s fulfillment of two conditions. Ryanair appealed the court’s execution of that ruling, but again drew the short straw yesterday. The oral hearing of the appeal was held on Sept. 27. The Irish airline argued that with the payment of over €50,000, it had complied with the condemnation and demanded that the judge invalidate the attachment GoMundo placed on Ryanair’s money in early August. GoMundo argued that it had in turn met the conditions (sending 298 receipts to Ryanair and providing a guarantee to Ryanair, ed.) as previously stated by the preliminary relief judge of the District Court of Noord-Holland and that Ryanair should therefore be held to pay more than two hundred thousand euros instead of the more than € 50,000 that had been paid to date. Also, the Haarlem-based OTA argued that Ryanair deliberately misinterpreted the summary judgment. In that, the judge just went along. The judge did find that GoMundo had complied with the conditions set out in the summary judgment for the payment of the more than two tons by Ryanair to GoMundo. The judge also ruled that Ryanair must pay the increased costs of the lawsuit.
